My Father had a Trust drawn up in another city but in the same state. He is now in Independent Living near me. If he wants to make changes to the Trust can he choose another lawyer in my city?

Wills can be changed at any time by your father. It’s his money and his decision to make.

You don’t mention any dementia or Alzheimer’s disease in your profile, so he is of sound mind and can do as he pleases.

Another lawyer can definitely make the change as long as your Father is in sound mind. By chance, does it have the first few pages of the trust? The new lawyer will need it so that he can correctly title the document.

If you consult with an attorney in your city who knows trusts and estates and senior law, that attorney can advise and assist in getting things moved to a more convenient office in your city. If the firm for your father's attorney is large, they may have an office in your city.

A good CELA (certified elder law attorney) will take your Father aside first to privately interview him. This is to ensure that he is not being pressured to make the changes, and also to assess whether he is cognitively competent to do so. In my family experience, having *mild* short-term memory impairment is not a disqualifier (and I'm only mentioning this because your profile says he is 91).

Mds1954, the answer is yes, your Father can choose another lawyer. I would recommend he make an appointment with the Elder Law Attorney.

To find one in your city, scroll down to the bottom of this page ..... click on Elder Law Attorneys..... now type in the city/state. That is how I found our Attorney :)

Sure. Your father can have any attorney anywhere change his trust. It is a simple thing to amend a trust. Be certain to keep the amendment to the trust with all trust papers, attached to it.
