I lived with her for 4 years and was on the lease with the apartment. So my mother passed away here very recently and now the landlord says I have one week to move out but I spoke with housing authority they said I could stay until 1st of October or if a single bedroom came up in my area. Can a landlord do that even though I was on the lease? They said since I was on the lease I was a caregiver so they don't have to give me notice. I never received a letter stating I had 30 days or anything. I don't know what to do. I had to quit my job to take care of my mother until she died. I did get a job just now and trying to save so I can get my own place again.

I would talk to Housing Authority again and get the extension in writing. You have a little time until Oct 1, maybe a single bedroom will become vacant. Meanwhile do you have any family or a friend you can stay with? You have enough going on after losing your mother and now you need to deal with all this. Another option would be to rent a motel room for the month. My brother did that when he had to move because of his dog. He rented an efficiency for a few months and it was cheaper by the month and less expensive than renting apartment. I hope everything works out for you and you get a place soon. You’re a tenant. You are on the lease and lived there more than long enough to establish tenants rights even if you weren’t on the lease. Indiana’s eviction moratorium ends in one week. Perhaps there is a misunderstanding between you and the landlords? He can begin the eviction process in 1 week but he has to do it legally. If this was a month to month lease than he has to give you a 30 day notice to quit. If it’s a yearly lease than he has to give you 90 days.
you should consider contacting the housing authority to get a new solo lease IF you are eligible to stay there—assuming this wasn’t senior housing that you aren’t eligible to live in by yourself.

the land lord was very clear and stated that i had one week to leave or he would have the police arrest me for trespass. this is not a senior housing. i have been here for 4 years. i talked with housing auth and she told me i had until oct 1st unless they found a 1 bedroom for me. thank you for your help.

Were you on the lease as your Mother's caregiver, or were you on the lease, period? Because I don't see how, if you just cosigned and were a co-leasee, how they would know WHAT you were doing there, other than living there. If there are housing rules as to two people getting a larger unit and you on the waiting list for a smaller, just be certain you STAY ON THAT LIST. And I wouldn't move until forced out. Check in your area what the Covid - 19 rules are. I am very sorry for your loss. And yes, keep saving.

yes i was the caregiver and i am on the lease it doesn't say care giver but the land lord says they dont have to abide by that state that i am a caregiver.

I don't understand why. If you are ale to pay the rent, why do you have to move? I was on the lease with my father, he needed to go to NH and eventually passed, and I kept the apartment and continued to pay the rent. As long as you pay the rent, why is the landlord forcing you to leave?

Dustin, when is the lease up? I don't think he can kick you out before the lease is up. You do need to pay the rent though. I would go to legal aid to see if they could help you. ASAP. Are you paying the rent? If you are, get a clear answer from the landlord why he is kicking you out. If you can't get anywhere with the landlord please see legal aid and HUD and social services. If you can't pay the rent, then its going to be harder for you to make a case.

Was your Mom on subsidized housing? Meaning now she is gone, the rent is not being subsidized anymore? Are you able to pay the full amount for now?

The landlord may say anything he wants but he needs to go thru the eviction process I would think. He doesn't want to because it cost him money. You need to call Housing Authority again, like said, and have them put what they say in writing and maybe call the landlord and tell him you r within your rights. I would think to get the police involved, the landlord will need to show them an eviction notice of some kind. There are tenant rights and sometimes they are not in the landlords favor. Even with a 30 day notice, I think, if the tenant does not leave the landlord then has to evict.
