I take her to make a 50 / 50 will between myself and my brother but then my brother gets her to make a will that excludes me? What makes it worse is that it's to him and his wife so mif In contest I'm contesting against two people. My mothers short term memory is poor but long term is good so thats all she talks about, what happened decades ago, I'm just tring to do the right thing but my mother can be very abusive at the drop of a hat for no reason and run to my brother to change the will. I just can't sleep at night.

My mother lives aloan and can quite easly as it seems look after her self, but her state of mind I think is definitely in question, seing a lawyer tomorrow, she did have a Legal Capacity test done that I took her to her own doctor, not sure of the result although it's clasified as a conflict of interest now with the lawyer I'm hoping he can tell me this Doctors report could be positive.

Keep notes of all the dates the will has been changed. Making five changes in 12 months does not speak well for a stable state of mind and will aid you should you contest.  I'm surprised that any reputable attorney would allow and take part in it.

Oh goodness, Tony, what a mess and what a worry for you.

How is this being done? Through a lawyer or not?

It sounds as if the validity of any wills made recently would be highly questionable for several reasons: your mother's capacity, the circumstances, and the vested interests of people advising and assisting her all throw doubt on it.

Has there been a formal diagnosis of dementia, and if so when, and if not hadn't you better arrange an assessment?

Who is caring for her now? Where does she live? How is her care being paid for?
