I hold a valid medical POA for my mother, I have asked the medical records person with a copy to the LNHA and the Diirector for the necessary form. I have also sent her two reminders. What can I do? I know I have a legal right to the information, I am concerned that they are withholding information that is critical to her welfare, what can I do? It has been 5 days and I know it is acceptable to fax such a form.

Does the nursing home have a copy of your medical POA? If so, they should be responding to your requests.

Time to take off the gloves. Ask to see their grievance policy procedure so you can find out who to call with complaints; that should at least get you a visit with the director. Call the ombudsman (you may be able to find that online for your state) and see how quickly they can help you; maybe even find a lawyer and just have them write a letter for starters. This is not acceptable on their part.

nursing home has court orders to send me medical records and the clerk and master of court says too bad this is a civil matter and i should go 1200 miles to tn and back to dallas . mom died 2 yrs ago, no records. brother and sil spent 300,k trust fund and got away with it. n/h would not let her cross brother off of revocable trust, told n/h i did not sign this. after 4 trips to tn. and guardianship court,lawyers and traveling cost...i am out 12k and nobody will help. brother is living high life and judge let bro. keep her. anybody who has ideas let me know. God bless

Well, if she is already deceased, the records are longer critical to her welfare. If you suspect your brother mishandled the estate and committed fraud, you should report that to the state attorney general where the crime was committed. You should also notify the IRS.
