My mother who lived with my sister was diagnosed with terminal cancer back in November. When we looked into her finances to prepare for her final expenses we discovered that all of her money was gone. Sister had POA and was grossly misusing funds for her own benefit. My mother passed away a few weeks ago. My father worked very hard to make sure that she would have money for proper care when she needed it. Instead all we could do was rely on Hospice Care which is a joke. My siblings and I were left to deal with trying to care for her without any medical experience. Only doing what Hospice told us. It was a horrific ordeal for my mother as well. We should have had plenty of money to hire a full time RN to help her stay comfortable and address her final needs. We are all very angry about what the sister did and when we ask her for explaination she refuses and is very ugly. I have all back statements, cancelled checks and copy of POA. I want to take this information to the District Attorney to see if I can have her prosecuted for Abuse of POA. Any advice on how best to approach DA would be greatly appreciated. Anyone with previous dealing with similar situation your thoughts and experience would also be greatly appreciated. Thanks

According to my attorney, having POA creates a responsibility and or trust between the two parties. It is the POA's responsibility to oversee funds to the best interest of the elder. I understand this is difficult, which is why it is called the crime of the century. POA in also now referred as "Power to Steal". But the records show gross misuse, for instance, using money to pay for her goats feed, paying for new furniture, paying for her own new teeth when my mother went without after hers were lost at the hospital. She went thru $175,000 in 20 months which she claims was all for my mothers care and refused to provide any documentation to the rest of us. That is an average of close to $9000/mth which is very very extreme. We could have hired a 24/7 RN for that amount of money. I just know I have to try because who is next ? Her mother-in-law ? Her brother-in-law who is handicapped ? The little old man that lives down the street from her ? I have to try to do something and not just look the other way and let her get away with it.

How will you prove that the expenses were not approved? The victim is deceased and cannot be deposed. Not sure here who the Executor is, but I would imagine the Executor is the one who would go to the DA.
